I am not a lawyer, nor do I play one on TV. My advice: let your conscience be your guide.
The BSA is unlikely to kick down the door and inspect your computer (though, with each new piece of legislation, it gets scarier!). Besides, if they do, those nasty sheep pics you think you've hidden so cleverly will get you in a lot more trouble than a EULA violation.
I own at least five full copies of VFP, and every MSDN since 1995 (separately, not upgrades). Business is a bit flush so far this year, so I wanted to place a vote for VFP with my wallet, to speak to Microsoft in the only language they understand, to help pay the salaries of Randy and Calvin and Mike and Cam and John. I encourage everyone to do the same, within reason.
Aren't you getting laid off? The upgrade should do you fine, imo.
